Changes to New Jersey’s business tax law for 2018

The New Jersey legislature approved changes to the state’s business laws in the latest legislative session, including temporary increases to the corporation business tax rate; mandatory combined reporting; sourcing of services based on where the benefit of the services is received; and a deduction based on an increase in the deferred tax liability resulting from unitary reporting, among other changes.

Changes to Chapter 48 impose a temporary tax on corporation business taxpayers at a rate of 2.5 percent for 2018-2019 and 1.5 percent for 2020-2021. The tax is set to expire in early 2022. Additional measures provide a response to federal tax law changes enacted in December 2017, including provisions relating to the dividends-received deduction, revised “treaty exception” to addback rules, interest deduction limitation, and IRC section 199A deduction.
