Alabama – Secretary of State Annual Report Requirement Repealed October 1

House Bill 230 (Act 2024-213) signed by the governor May 6 and effective October 1 repeals the requirement for domestic and foreign corporations to file an annual report with the Secretary of State between January 1 and March 15 and pay a $10.00 processing fee. The bill text can be accessed here.

Delaware – New August 2024 Legislation

Senate Bill 245 (Chapter 355) signed by the governor and effective August 9 amended the Delaware Code to repeal the January 1, 2025 expiration dates for the office of Foreclosure Prevention and Financial Education and loss mitigation affidavits required in residential mortgage foreclosures. Senate Bill 249 (Chapter 392) signed by the governor and effective August 29 amended Title 18 of the Delaware Code to provide the Insurance Commissioner with additional flexibility to approve financial institutions authorized to hold required capital and surplus of captive insurance companies. Senate Bill 266 (Chapter 367) signed by the governor and effective August 15 clarified the process and roles of certain state officials under the False Claims and Reporting Act for failure to comply with reporting requirements of the Unclaimed Property Law. The bill text can be accessed here.

Senate Bill 268 (Chapter 391) signed by the governor and effective August 29 amended Title 12 of the Delaware Code relating to decedents’ estates and fiduciary relations to among other things amend the definition of registering entities under the Uniform TOD Security Registration Act.
