Kansas has joined the growing list of states that have enacted the 2010 Amendments to UCC Article 9. The governor signed House Bill 2621 on Friday, April 6, 2012. The new law adopts the Alternative A “Only If” approach for individual debtor name sufficiency in Section 9-503(a)(4) and takes effect on July 1, 2013.
The new law omits the safe harbor form amendments to Section 9-521. Instead, Kansas will retain its current non-uniform version of Section 9-521 that requires a filing office to accept forms prescribed by the secretary of state.
