Legislative Updates – 2010 Amendments to UCC Article 9

Alabama: SB 28 to enact the 2010 Amendments was fast tracked and passed the Senate on 1/23/14. The bill was promptly transmitted to the house where it is pending.

Alabama: HB 32 to enact the 2010 Amendments is pending its Third Reading and a vote, which will occur soon.

Missouri:  House Bill 1376 was introduced on 1/14/14 to amend the 2010 Amendments as enacted last year.  The bill adds “nondriver identification card” to the bracketed text of UCC § 9-503(a)(4) Alternative A in addition to the driver’s license as the sufficient source of an individual debtor name.  In addition, HB 1376 makes a number of other minor changes to fix some minor omissions and oversights in the 2010 Amendments law enacted in MO last year.  That includes changing the end of the transition period in § 9-805(b)(2)(B) to provide a full 5-year period running from the delayed effective date of August 28, 2013.

 New York:  SB 5901, the omnibus UCC bill that includes the 2010 Amendments to Article 9, was referred to the Senate Judiciary Committee on 1/8/14.  This was the first action on the bill since it was introduced in June 2013.
