Massachusetts – Enacts the 2010 Amendments to UCC Article 9

Massachusetts finally enacted the 2010 Amendments to UCC Article 9 when the governor signed House Bill 28 on the afternoon of Monday, July 1, 2013.  The new law includes not only the Article 9 amendments, but also revisions to UCC Articles 1 and 7, and § 4A-108.  The bill provides the Alternative A “Only If” rule for sufficiency of individual names in § 9-503(a)(4) and includes images of the safe harbor forms provided in the official text of the 2010 Amendments.  The new law took effect immediately.

CSC will continue to track all UCC Article 9 legislation and provide updates of any significant developments.
