North Dakota – Central Index Electronic Filing Law Effective March 1

The new electronic filing law for central index records will take effect on March 1, 2016. The Secretary of State will shut down its central indexing system for UCC and other liens at the close of business next Tuesday, February 23, 2016. At that time the filing office will begin implementation and testing of its new electronic filing system. The system will be down until Monday, March 1, 2016. No UCC records can be filed during that time, so plan ahead for any upcoming transactions. Once the new system goes live, all UCC records must be filed electronically. Any paper records received by the Secretary of State by mail or other means after the close of business on February 23, 2016 will be rejected. One other reminder – any UCC financing statement filed in the central index on or after March 1, 2016 must include the SSN or FEIN for each debtor.
